Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Masjid Sync at masjidsync.uk and related applications (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms.
If you use the Service on behalf of a masjid, charity, or organisation, you confirm you have authority to bind that organisation, and “you” includes that organisation.
1. Agreement
These Terms form a binding agreement between you and the operator of Masjid Sync. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data and forms part of your understanding of the Service.
2. The Service
Masjid Sync provides tools for masjid operations such as prayer schedules, public pages, donation ledgers, announcements, events, displays, and related features. Features may change, be added, or be discontinued as we improve the product.
We provide software and hosting. We are not a bank, payment institution, charity regulator, or legal adviser. We do not take custody of cash donations recorded in the ledger unless a specific payment feature (such as Stripe Connect) is enabled and used under that provider’s rules.
3. Accounts and access
You must provide accurate registration information and keep it updated. You are responsible for all activity under your account and for safeguarding credentials.
Committee owners and admins control who can access their masjid workspace. You must promptly remove access for people who should no longer use the workspace. We may suspend accounts that appear compromised, abusive, or unlawful.
4. Masjid responsibilities
Each masjid committee is solely responsible for:
• the accuracy of prayer times, announcements, events, and public content; • complying with charity, financial, tax, AML, and privacy rules that apply to them; • obtaining any consents needed to collect and process donor or worshipper data; • how they handle cash, bank transfers, and offline giving; • verifying their own identity and registration details when requested; • resolving disputes with donors, worshippers, or volunteers.
Masjid Sync does not verify the religious, financial, or legal correctness of content a committee publishes.
5. Acceptable use
You must not:
• break the law or infringe others’ rights; • upload malware, scrape the Service abusively, or attempt unauthorised access; • misuse the Service for fraud, spam, harassment, or deceptive fundraising; • reverse engineer the Service except where mandatory law allows; • resell or sublicense the Service without our written permission; • impersonate another person or misrepresent affiliation with a masjid or charity.
We may remove content or suspend access when we reasonably believe these rules are breached.
6. Payments and donations
Online card payments, when enabled, are processed by Stripe (or another stated provider) under that provider’s terms and privacy policy. Donation amounts, fees, refunds, chargebacks, and payout timing are between the donor, the masjid, and the payment provider.
Recording a donation in Masjid Sync does not by itself create a regulated payment, tax receipt, or gift-aid claim unless you separately meet those legal requirements. Committees must not use the Service to mislead donors.
7. Content and intellectual property
You retain rights in content you upload. You grant us a worldwide, non-exclusive licence to host, display, and process that content solely to operate and improve the Service.
The Service software, branding, and design are owned by us or our licensors. You may not copy or create derivative works from our software except as needed to use the Service.
8. Availability and “as is” service
We aim for reliable uptime but do not guarantee uninterrupted or error-free Service. Maintenance, outages, third-party failures, and force majeure events may occur.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will meet your fundraising, regulatory, or operational requirements.
9. Limitation of liability
To the maximum extent permitted by law:
• we are not liable for indirect, incidental, special, consequential, or punitive damages; • we are not liable for lost profits, lost donations, lost data, business interruption, reputational harm, or substitute service costs; • we are not liable for decisions, content, or financial handling by a masjid committee; • we are not liable for payment-provider failures, bank delays, or donor disputes; • our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the fees you paid us for the Service in the 12 months before the claim, or (b) GBP £100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.
You agree that these limits are a fair allocation of risk and a foundation of our ability to offer the Service.
10. Indemnity
You will defend and indemnify us against claims, losses, and reasonable costs arising from: your content; your misuse of the Service; your breach of these Terms; or your violation of law or third-party rights — except to the extent caused by our wilful misconduct.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continuing would create legal or security risk.
On termination, your right to use the Service ends. Provisions that by nature should survive (including liability limits, indemnity, and governing law) will survive.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or security.
Before filing a claim, you agree to email legal@masjidsync.uk and attempt good-faith resolution for 30 days.
13. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and may notify account holders of material changes. Continued use after changes take effect constitutes acceptance, except where mandatory law requires otherwise.
If a provision is found unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement regarding the Service and supersede prior conflicting understandings about the same subject.
